Chapter 1 — The Briar Case

Page 1 of 2 • ~2 min read

The Briar case had been closed for fourteen months.Detective Nora Voss, Homicide Division, City of Ashfield, had closed it herself. The file was clean: one victim, one suspect, one conviction. Raymond Briar, forty-four, found dead in his car in the Meadow Park garage on the night of October 9th, two years ago. Blunt force trauma to the head. His business partner, Gerald Morrow, convicted eleven months ago on the strength of financial motive, forensic evidence, and a witness who placed him at the scene. It was one of the cleaner cases of her career. She had been proud of it.She had not thought about it in four months. She thought about it now, sitting at her kitchen table at 1 AM with the Briar file — her own personal copy, which she kept as a matter of habit — open in front of her, and Marcus's voicemail playing for the sixth time on her phone. The file is wrong. She went through it methodically, the way she would go through any cold case: start with the evidence and work backward to the conclusion, checking whether the conclusion followed from the evidence or whether the evidence had been arranged to support a predetermined conclusion. The forensic evidence: a partial fingerprint on the murder weapon — a tire iron — that matched Gerald Morrow's left thumb. A fiber from Morrow's jacket found at the scene. Morrow's car recorded on CCTV entering the garage at 9:14 PM, twenty minutes before the estimated time of death. The witness: a parking attendant named Derek Chu who had seen a man matching Morrow's description near Briar's vehicle at approximately 9:25 PM.The motive: a business dispute over $2.3 million in disputed assets following a failed expansion. Morrow stood to gain sole control of the company with Briar dead.It was solid. Every component supported every other component. Clean cases were satisfying precisely because of this — the interlocking quality, no loose threads. She read it again, looking for the thread. She found one at 2:30 AM.The parking attendant, Derek Chu, had given his statement on October 11th, two days after the murder. In the statement he described the man near Briar's vehicle as "wearing a dark jacket, medium height, heavyset, dark hair." Morrow was five-eleven, one hundred and ninety pounds, dark hair. The description fit.But there was a note in the margin of the statement — her own handwriting, which she didn't remember making: confirmed ID from photo array, 10/14.She had conducted the photo array on October 14th. She had confirmed that Derek Chu selected Gerald Morrow's photograph. She had not recorded which photograph number Morrow appeared in the array. This was not illegal. It was sloppy, by her standards — she was meticulous about documentation — but it was not illegal and it was not, on its face, evidence that anything was wrong.
